4. Consent and Your Choices

We collect, use, and disclose personal information with your knowledge and consent, except where consent is not required or is inappropriate under applicable law. The form of consent may be express or implied depending on the sensitivity of the information and the circumstances.

You may withdraw consent for future collection, use, or disclosure by contacting us, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may mean that we cannot provide a requested service. Withdrawal does not affect uses or disclosures already made with valid consent.

You may unsubscribe from promotional emails using the unsubscribe link in the message or by contacting us. You may also manage cookies through the controls made available on our website and through your browser settings. Blocking certain cookies may affect website functionality.

5. Cookies, Analytics, and Advertising

Our website and the services embedded in it may use cookies, pixels, local storage, and similar technologies. These technologies may be necessary for the website to function, remember preferences, support scheduling and payments, measure traffic and engagement, identify technical issues, and help us understand or improve our marketing.

Some analytics, social media, or advertising providers may collect information about your activity on our website and other websites over time. Where required, we ask for consent before using non essential cookies or similar technologies. You can adjust your choices through our cookie controls, when available, and your browser or device settings.

6. How We Share Personal Information

We do not sell personal information.

We may disclose personal information in the following circumstances:

To the ISLE artist, guest artist, instructor, staff member, or contractor who needs the information to respond to you, manage your booking, provide the requested service, or support studio operations. Artists at ISLE may operate as independent businesses and may have their own privacy practices for information they collect directly.

To service providers that host or operate our website, forms, scheduling, payment processing, email, cloud storage, communications, analytics, advertising, accounting, security, and other business systems. These providers may use personal information only to provide services to us or as otherwise permitted by their own terms and applicable law.

To professional advisers, insurers, financial institutions, auditors, and legal or regulatory authorities where reasonably necessary.

Where required or permitted by law, including to comply with a court order, legal process, tax requirement, public health requirement, or lawful government request.

Where reasonably necessary to investigate fraud, enforce an agreement, collect an amount owed, respond to an emergency, or protect rights, property, safety, or security.

In connection with a proposed or completed financing, reorganization, sale, transfer, or other business transaction involving all or part of ISLE or The Softboy Inc., subject to appropriate confidentiality and legal requirements.

With your direction or consent.

7. Independent Artists and External Services

ISLE provides a shared studio environment for artists, some of whom operate as independent contractors or independent businesses. If you contact or book an artist directly, that artist may collect and control personal information separately from ISLE. Questions about information held independently by an artist should be directed to that artist.

Our website may contain links to artist websites, social media platforms, maps, payment pages, scheduling pages, or other third party services. We do not control the privacy practices of third parties. We encourage you to review their privacy information before providing personal information.

8. Information Stored or Processed Outside Canada

Some of our service providers may store or process personal information outside Ontario or Canada, including in the United States. When information is processed in another jurisdiction, it may be subject to that jurisdiction’s laws and may be accessible to courts, law enforcement, or government authorities there. We remain accountable for personal information under our control and use contractual or other measures appropriate to the circumstances when engaging service providers.

9. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, to maintain appropriate business and client records, and to meet legal, tax, accounting, insurance, safety, and dispute resolution requirements.

Retention periods vary according to the nature and sensitivity of the information, the reason it was collected, applicable limitation periods, and legal requirements. When information is no longer required, we securely delete, destroy, or anonymize it, subject to technical limitations and lawful backup or archival practices.

10. Safeguards

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the personal information we hold. These may include limiting access to people who require it, account controls, secure service providers, staff and contractor confidentiality expectations, and secure disposal practices.

No system or transmission method is completely secure. You should avoid sending highly sensitive information through unencrypted email or social media unless we specifically ask you to do so through an appropriate process.

11. Access, Correction, and Privacy Requests

You may request access to personal information we hold about you, ask us to correct inaccurate or incomplete information, withdraw consent, or ask a question or make a complaint about our privacy practices. We may need to verify your identity before responding.

Access may be limited where permitted or required by law, including where disclosure would reveal another person’s personal information, confidential commercial information, or information protected by legal privilege. If we cannot fulfil a request in whole or in part, we will explain the reason where legally permitted.

We will respond within the time required by applicable law. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.

12. Children and Minors

Our website is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the website without appropriate consent. Tattoo services for minors are subject to ISLE’s age, identification, and consent requirements and applicable law. A parent or legal guardian may contact us regarding personal information submitted by or about a minor.

13. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to our services, technology, practices, or legal obligations. The revised policy will be posted at isletattoo.co with a new effective date. Material changes will be highlighted or otherwise communicated where appropriate.
